Rezoning Process:
The general process for rezoning is:
- Submittal of a complete application and fee
- Staff reviews application materials and prepares a written recommendation
- Public hearing before the Hearing Examiner - Applicants must give a presentation and respond to questions or cross-examination
- Hearing Examiner prepares a written decision or recommendation
- Public hearing before the Board of County Commissioners who then make a decision
Public Participation in Public Hearings:
The public may participate in zoning hearings. Read more about Public Participation and view the Public Participation Guide. Procedures for the conduct of the public hearings before the Hearing Examiner are established in Administrative Code AC-2-6.
Lee County regulations prohibit ex parte communications with the Board of County Commissioners (or their executive assistants) and the Hearing Examiners (or their staff) on pending zoning matters.
